1. Introduction:
Welcome to TheTradeMakers.com (the “Website”), operated by TheTradeMakers (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our Website, products, and proprietary trading programs (collectively, the “Services”).
By accessing our Website or enrolling in any trading program, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Website or Services.
2. Program Overview
TheTradeMakers provides access to simulated proprietary trading programs designed to assess and train traders (“Programs”). We do not provide brokerage, investment, or financial advisory services. All trading accounts are simulated or internal-risk accounts used solely for evaluation or performance purposes.
3. Eligibility
You must:
- Be at least 18 years of age and legally capable of entering binding contracts;
- Not be restricted by any sanctions or regulatory prohibitions;
- Provide accurate, truthful, and complete information during registration.
- We reserve the right to refuse access to any applicant or terminate access for non-compliance.
4. Account Registration and Activation
Activation occurs upon:
- Successful payment of applicable program fees;
- Acceptance of these Terms and any specific Program Schedule;
- Confirmation email or account credentials issued by TheTradeMakers.
You are responsible for maintaining confidentiality of your login information and for all activities under your account.
5. Program Types
TheTradeMakers offers several program categories:
Equities Programs
- Evaluation-Based Program
- Instant Funding Program
Futures Programs
- Evaluation (“Eval”) Program
- Straight-to-Sim Funded Program
Each program may have unique rules, objectives, and payout criteria described in its respective Program Schedule, which forms part of these Terms.
6. Fees, Refunds, and Costs
- Program fees are due in full at purchase.
- Once credentials are issued, fees are non-refundable, except where required by law.
- Applicable trading commissions, exchange, routing, or market data fees may apply as outlined in each Program Schedule.
We reserve the right to adjust pricing or fee structures with prior notice.
7. Trading Rules and Risk Limits
All Programs include defined risk parameters such as:
- Maximum Daily Loss
- Maximum Account Drawdown
- Consistency Rules (e.g., 20% or 40%)
- News or Earnings Restrictions
- Overnight Position Rules
- 30% Negative PnL Rule
Violating these rules may result in disqualification or termination without refund.
You may hold up to five Simulated Funded Accounts across all Program types unless otherwise authorized.
8. Prohibited Conduct
You agree not to:
- Exploit latency, pricing errors, or system glitches;
- Hedge by holding opposing positions on the same or correlated instruments (e.g., long ES/short MES);
- Use third-party automated systems or bots unless explicitly permitted under Program rules;
- Engage in abusive, manipulative, or unethical trading behavior;
- Share login credentials or trade on behalf of others.
Automation in Futures Programs is permitted only for approved, verified bots personally owned by the trader — no high-frequency or shared systems allowed.
